Fragrances, Perfumes and Related Cosmetic Products

1. Introduction and Scope
This Legal Notice and Disclaimer (the "Notice") governs your access to and use of the website, mobile pages, applications and all related content and services operated by My Store - entity (the "Company", "we", "us" or "our") under the brand name My Store (the "Store"), and applies to every fragrance, perfume, eau de parfum, eau de toilette, cologne, body mist, home fragrance and related cosmetic product offered through the Store (each a "Product").
By accessing the Store, creating an account, placing an order or using any Product purchased from us, you confirm that you have read, understood and agreed to this Notice. If you do not agree, please do not use the Store. This Notice does not limit any right you have under applicable consumer protection law that cannot lawfully be excluded.
2. Intellectual Property
All content made available through the Store, including the brand name, logos, product names, packaging design, bottle shapes, label artwork, photography, videography, written descriptions, fragrance pyramid narratives, typography and the overall look and feel of the Store, is owned by or licensed to the Company and is protected by copyright, trademark, design and other intellectual property laws.
You may view and print pages of the Store for your own personal, non-commercial use in connection with shopping with us. You may not reproduce, republish, distribute, scrape, frame, mirror, sell, license or create derivative works from any part of the Store, or use our brand names, logos or product imagery in advertising, on marketplaces, in social media commerce listings or in any manner likely to suggest endorsement or affiliation, without our prior written permission.
Where the Store offers genuine third-party branded fragrances, all trademarks referenced remain the property of their respective owners. We disclaim any affiliation, sponsorship or endorsement beyond the resale of genuine goods, and we do not alter, refill, rebottle or repackage third-party branded products for sale.
3. Product Information and Descriptions
We aim to describe each Product accurately, including its olfactive family, fragrance notes, concentration, intended wear occasion, bottle size and country of manufacture. The following natural variations and limitations apply to all fragrance purchases:
(a) Fragrance descriptions are editorial in nature. Notes listed as top, heart and base describe the intended composition and perceived development over time; they are not a chemical ingredient list and individual perception varies with skin chemistry, body temperature, climate and humidity.
(b) Fragrances are produced in batches. Bottle design, cap, atomiser, label finish, outer carton and batch coding may differ between production runs while the fragrance formula remains consistent.
(c) Photographs and video are styled under controlled lighting. The actual colour of liquid, glass tint, metallic finishes and label tone may appear different on your screen. Monitor calibration, ambient light and image compression can all affect perceived colour.
(d) Stated fill levels, net volumes and dimensions are subject to normal manufacturing tolerances. A bottle that appears slightly below the nominal fill line immediately after opening is consistent with standard filling practice and does not indicate a short measure.
(e) Any longevity, projection or sillage statement is an approximate expectation based on our own wear testing and common experience. It is not a guarantee of performance on your skin, in your climate or under your layering routine.
If a Product description, price or specification contains an error, we reserve the right to correct it and to cancel and refund any order placed on the basis of that error before dispatch.
4. Ingredients, Allergens and Formulation Disclosure
Fragrance products are cosmetic preparations. Full ingredient declarations, where required by the cosmetics labelling rules applicable to the market of sale, appear on the primary packaging, the outer carton or an accompanying leaflet. Fragrance compounds are typically declared as "parfum" or "fragrance" on the label in accordance with applicable regulation, with individual fragrance allergens listed where they exceed the applicable labelling threshold.
If you have a known fragrance allergy, sensitisation, asthma, dermatitis or other skin condition, or if you are pregnant, nursing or under medical care, please contact us at joannesanchez6621@outlook.com before ordering so that we can confirm the allergens declared for the specific Product and batch you intend to buy. We will provide the information we hold; we cannot provide a medical opinion on your suitability.
Fragrance formulas may be updated by the manufacturer from time to time in response to regulatory changes or reformulation. Where a formula has changed, the ingredient declaration on the packaging of the batch supplied to you is the authoritative version for that Product.
We do not manufacture, blend, dilute, decant or refill fragrance products unless a Product is expressly described as a travel spray, decant or sample prepared by us. Any such preparation is described on the Product page together with its container type and nominal volume.
5. Intended Use, Safety Warnings and Handling
Products are intended for external use only, applied to intact skin, and in the case of home fragrance, used as directed for ambient scenting. The following warnings apply to every Product unless the Product page states otherwise:
(a) Flammable. Alcohol-based fragrances contain ethanol and are class 3 flammable liquids. Keep away from open flame, sparks, lit cigarettes, candles, stoves and any source of ignition. Do not spray near heat, and do not store bottles in a hot vehicle, in direct sunlight or near a heat source.
(b) Do not ingest. Fragrance products are not beverages, food, dietary supplements or medicine. Ingestion can cause serious harm. If swallowed, seek immediate medical advice and keep the packaging available for the treating clinician.
(c) Avoid contact with eyes, mucous membranes, broken or irritated skin, and never spray toward the face or into the eyes. If contact with eyes occurs, rinse thoroughly with clean water for several minutes and seek medical attention if irritation persists.
(d) Keep out of reach of children and pets. Store upright, capped, in a cool dry place away from light.
(e) Do not use on children, on inflamed or damaged skin, or over wounds. Discontinue use if redness, itching, burning, swelling or any other reaction develops, and consult a physician if symptoms persist.
(f) Some fragrance materials can discolour or damage fabrics, leather, jewellery, watch straps, plated metals, pearls, lacquers and some plastics. Apply with care and allow the product to dry before contact with such materials.
(g) Home fragrance products, reed diffusers and candles require additional handling precautions which are stated on the relevant Product page and packaging and must be followed.
We recommend a patch test before first full use: apply a small amount to the inner forearm, wait twenty-four hours and discontinue use if any reaction appears. Cease use and seek medical advice if you experience breathing difficulty, widespread rash, facial swelling or any severe reaction.
6. Age Restriction and Capacity
The Store and the Products are intended for purchase by persons who have reached the age of majority in their place of residence, and in no event by persons under eighteen (18) years of age. By placing an order you represent that you meet this requirement and that you have the legal capacity to enter into a binding contract.
We may refuse, cancel or hold any order where we reasonably believe the purchaser is below the required age, or where age verification is required by the payment provider or the destination jurisdiction. Where an order is cancelled on this basis, any amount already paid will be refunded.
7. Prices, Taxes, Duties and Orders
All prices are stated in the currency shown at checkout. Prices, promotions and availability may change without notice, but the price displayed at the moment your order is confirmed applies to that order. Where sales tax, goods and services tax or value added tax applies, it is calculated at checkout based on the delivery address.
For international orders, import duties, customs clearance fees and local taxes are determined by the destination customs authority and are the responsibility of the recipient unless the Store expressly states that duties are prepaid at checkout. We cannot predict or reimburse amounts assessed on import, and we cannot alter the declared value or description of a shipment.
An order is accepted only when we send a dispatch confirmation. Until then, we may decline or cancel an order, including where a Product is out of stock, where a pricing or description error has occurred, where fraud or payment verification checks are unresolved, or where shipping restrictions apply to the destination.
8. Shipping, Transport Restrictions and Delivery
Alcohol-based fragrances are regulated dangerous goods for transport. Depending on the volume, packaging and route, shipments may be restricted to ground transport within the continental United States, may be limited to specific quantities per parcel, may be unavailable by expedited air service, and may be unavailable to certain destinations, including remote areas, island territories, military addresses and jurisdictions that restrict the import of alcohol-based cosmetics.
Where a destination or service level cannot lawfully or safely carry your order, we will notify you and either remove the restricted item, split the shipment or cancel and refund the affected portion. We will not misdeclare a fragrance as a non-hazardous cosmetic in order to bypass carrier or customs rules.
Delivery estimates are indicative and are not guaranteed dates. Risk of loss passes to you on delivery, but title passes only on payment in full. You must inspect the parcel on arrival and report visible damage, leakage or shortages within the period stated in Section 9, retaining the packaging and photographic evidence. A signature may be required for certain orders.
9. Returns, Exchanges and Hygiene Restrictions
Fragrance and cosmetic products are sealed hygiene goods. Once the outer seal, shrink wrap or cellophane has been removed, or the bottle has been opened, sprayed or tested, the Product can no longer be resold and is not eligible for return on change of mind. This restriction does not affect your rights where a Product is defective, damaged, incorrectly supplied or not as described.
Subject to the above, we accept returns of unopened, sealed Products notified to us within thirty (30) days of delivery, in their original packaging with all seals intact and accompanied by proof of purchase. Return shipping is arranged as set out on the Store returns page. Refunds are issued to the original payment method after inspection.
If a Product arrives damaged, leaking, broken or incorrect, notify us within seven (7) days of delivery with photographs of the parcel, the outer carton, the bottle and the batch code. We will arrange a replacement or a full refund including original shipping charges, at your choice, where the issue is attributable to us or to the carrier.
Scent preference is personal and is not a defect. Where the Store offers samples, discovery sets or a sampling option, we encourage you to try before committing to a full bottle. We do not accept returns on the grounds that a fragrance "smells different" from expectation where the Product supplied matches its description and batch.
Because Products are supplied through wholesale distribution rather than under brand authorisation, any manufacturer or brand warranty, authenticity certification scheme or brand after-sales programme is not transferred with the sale. All after-sales obligations towards you are owed by us as the seller and are set out in this Section. Nothing in this paragraph limits any statutory right you may have against us.
10. Authenticity, Grey Market and Product Provenance
We undertake to supply only genuine Products obtained through established wholesale and distribution channels, and to disclose on the Product page where a Product is a tester, unboxed unit, travel size, decant, discontinued batch or otherwise not a standard retail unit.
Our Products are supplied through wholesale distribution and are not sold under a direct authorisation agreement with the brand owners. Unless the Product page states otherwise, we are not an authorised dealer or appointed retailer for any brand named on the Store, and we do not represent any affiliation with, sponsorship by or endorsement from any brand owner. Manufacturer warranties, brand-operated after-sales programmes, brand loyalty schemes and brand customer service may therefore not apply to Products purchased from us, and a brand boutique or authorised retailer may decline to service a Product not bought from it.
After-sales service for any Product you buy from us is provided by us, in accordance with Section 9. Where a Product is defective on arrival or within the period stated in Section 9, we will repair, replace or refund it ourselves rather than directing you to the brand. This does not reduce any statutory right you hold against us as the seller.
We do not sell counterfeit, replica, "inspired by" or refilled products presented as branded goods. If you believe a Product supplied by us is not genuine, contact us immediately at joannesanchez6621@outlook.com with photographs and the batch code; we will investigate and, where the concern is substantiated, refund the purchase in full.
11. Acceptable Use of the Store
You agree not to use the Store in any way that breaches applicable law, infringes the rights of others, or interferes with its operation. In particular you must not:
(a) submit false, misleading or third-party personal information, or impersonate any person;
(b) attempt to gain unauthorised access to any account, system, server or database, probe or scan for vulnerabilities, or circumvent security or access controls;
(c) introduce malware, conduct denial-of-service attacks, or use automated scripts, crawlers or scrapers to extract content, pricing or inventory data;
(d) resell Products in a manner that misrepresents their origin, condition or authenticity, or resell tester, sample or decant Products as full retail units;
(e) post or transmit unlawful, defamatory, obscene or infringing material in any review, comment or message feature.
We may suspend or terminate access, cancel orders and report conduct to the relevant authorities where these rules are breached.
12. Third-Party Links, Reviews and Marketplace Listings
The Store may link to third-party websites, payment providers, logistics partners, social platforms and product information sources. Those sites are not under our control and we are not responsible for their content, terms, privacy practices or availability. A link does not imply endorsement.
Customer reviews, ratings and user photographs reflect individual opinions and experiences. We do not verify every statement in user-generated content, and publication of a review is not an adoption of the views expressed. Where Products are also listed on third-party marketplaces, the terms of that marketplace apply to the corresponding transaction in addition to this Notice.
13. No Medical or Professional Advice; Disclaimer of Warranties
Nothing on the Store constitutes medical, dermatological, pharmaceutical or other professional advice, diagnosis or treatment. Fragrance Products are cosmetics and are not medicines, drugs, therapeutic products or medical devices, and no statement on the Store should be read as a claim that any Product diagnoses, treats, cures or prevents any condition. Always seek the advice of a qualified physician or dermatologist regarding a medical condition or a suspected allergic reaction.
To the fullest extent permitted by law, the Store and all content are provided on an "as is" and "as available" basis, and we disclaim all implied warranties, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Store will operate uninterrupted, secure or error-free, that defects will be corrected, or that any content is complete, current or accurate. Nothing in this Notice excludes or limits any warranty or right that cannot lawfully be excluded or limited, including statutory consumer guarantees.
14. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, punitive or exemplary loss, nor for loss of profit, revenue, goodwill, data, opportunity or anticipated savings, arising out of or in connection with your use of the Store or any Product, whether based in contract, tort, negligence, strict liability or otherwise, even if we have been advised of the possibility of such loss.
Our total aggregate liability arising out of or relating to any Product is limited to the amount you actually paid for that Product, including any shipping charge paid. This limitation does not apply to liability that cannot lawfully be limited, including liability for death or personal injury caused by our negligence, for fraud, or for any statutory consumer right that cannot be waived.
We are not responsible for loss or damage resulting from misuse of a Product, failure to follow the warnings in Section 5, storage in unsuitable conditions, application to broken or sensitised skin, or reliance on an approximate longevity or performance statement.
15. Indemnification
You agree to indemnify, defend and hold harmless the Company, its officers, employees, agents and suppliers from and against any claim, demand, loss, liability, damage, cost or expense, including reasonable legal fees, arising out of or in connection with your breach of this Notice, your misuse of a Product, your violation of any law or third-party right, or your resale or representation of a Product in a misleading manner. This obligation survives the end of your use of the Store.
16. Privacy and Data Processing
We process personal information in accordance with our Privacy Policy, which forms part of the terms governing the Store. In summary, we collect the information needed to process orders, communicate about them, provide customer service, prevent fraud and meet legal obligations, and we share it only with service providers acting on our instructions, such as payment processors, carriers and platform providers, or where required by law.
We do not sell personal information. Depending on your place of residence you may have rights to access, correct, delete, restrict or port your information, or to object to certain processing. Requests can be made to joannesanchez6621@outlook.com. Fragrance preference information you share with us for recommendations is used only to provide that service.
17. Governing Law and Dispute Resolution
This Notice and any dispute or claim arising out of or in connection with it, the Store or any Product shall be governed by the laws of the State of California, United States, without regard to conflict of law principles and without prejudice to any mandatory consumer protection rules of your place of residence.
Before commencing formal proceedings, you agree to first contact us at joannesanchez6621@outlook.com with a written description of the issue so that the parties may attempt to resolve it in good faith within a reasonable period. If the matter is not resolved, the parties submit to the exclusive jurisdiction of the competent courts of the State of California, United States. Nothing in this section prevents either party from seeking urgent injunctive or equitable relief, or from bringing proceedings in a forum whose jurisdiction cannot lawfully be excluded.
18. Changes to this Notice
We may amend this Notice at any time to reflect changes in our Products, our operations or applicable law. The revised version takes effect when published on the Store with an updated effective date. Material changes will be brought to your attention by a notice on the Store or by email where we hold a valid address and the change affects an existing order or your rights. Your continued use of the Store after publication constitutes acceptance of the revised Notice, and the version in force at the time of your order governs that order.
